Two broad types
IRCC describes two broad work-permit types: employer-specific permits and open work permits. Employer-specific permits are tied to conditions such as the named employer; an LMIA may be required depending on the category. Open work permits are available only in defined circumstances.
LMIA and LMIA-exempt routes
Some employer-specific work permits rely on a positive LMIA, while others may be LMIA-exempt under a specific legal or program basis. The exemption itself must fit the facts; it is not enough simply to have a job offer.
Extensions and maintained status
A worker who applies to extend or change a work permit before expiry may be able to remain in Canada under maintained status and may continue working under the original permit conditions while a qualifying work-permit application is processed. Switching to a visitor or study application changes the work-authority analysis.
Short study while holding a work permit
A temporary public policy effective September 4, 2026 allows certain valid work-permit holders to study in a program of six months or less without a study permit, subject to the policy conditions and expiry.
What to bring
Passport; current and prior permits; job offer and employment contract; employer documents; LMIA or LMIA-exemption information if applicable; proof of qualifications; and prior applications or refusals.
